MEDIA GALLERY TERMS
To the extent your access and use of the Media Gallery complies with all applicable laws and any contractual relationship you may have with Blue-Grace Logistics LLC ("BlueGrace"), BlueGrace® grants you the revocable, non-transferable, non-sublicensable right to access and use all information, materials, functions and content available on the Media Gallery, and download content therefrom, as available, provided you (a) keep intact all copyrights, trademarks and other proprietary notices; (b) you make no modifications to the content; (c) ensure that your use of the BlueGrace trademarks reflects favorably on BlueGrace, its products, services and technologies, and you do not disparage BlueGrace or its products, services or technologies; and (d) do not use BlueGrace trademarks as part of your company, product or service name unless you have an express contractual right with BlueGrace to do so.
You acknowledge in whole or in part that BlueGrace is the sole owner of the copyrights and trademarks in the Media Gallery and promise that you will not interfere with the copyright and trademark rights of BlueGrace, including challenging BlueGrace's use of, registration of, or application to register such copyrights and trademarks, alone or in combination with other words, anywhere in the world, and that you will not harm, misuse, or bring into disrepute any BlueGrace copyright or trademark. The goodwill derived from using any part of any BlueGrace copyright or trademark exclusively inures to the benefit of and belongs to BlueGrace.
BLUEGRACE MAKES NO WARRANTY IN CONNECTION WITH YOUR ACCESS AND USE OF THE MEDIA GALLERY AND ITS CONTENTS AND HEREBY DISCLAIMS ANY AND ALL IMPLIED WARRANTIES, INCLUDING ALL IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE REGARDING SUCH SUBJECT MATTER.
